1. Introducción.
El presente documento tiene como finalidad el establecer y regular las normas de uso del Sitio http://www.allmadrid4all.com (en adelante el "Sitio"), entendiendo por Sitio todas las páginas y sus contenidos propiedad de PREDIF a las cuales se accede a través del dominio http://www.allmadrid4all.org y sus subdominios. 2. La utilización del Sitio, supone la aceptación plena por el Usuario de estas condiciones, por lo que si no está de acuerdo con el contenido de las mismas deberá abstenerse de hacer uso de la web, así como de los servicios ofrecidos en ella. PREDIF se reserva el derecho a efectuar las modificaciones que estime oportunas, pudiendo modificar, suprimir o incluir, sin previo aviso, nuevos contenidos y/o servicios, así como la forma en que éstos aparezcan presentados y localizados y las condiciones de uso de la web. El Usuario acepta que el acceso y uso de la web y de los contenidos incluidos en la misma tiene lugar libre y conscientemente, bajo su exclusiva responsabilidad, y en consecuencia se compromete a:
PREDIF no garantiza la disponibilidad y continuidad de la web ni se hace responsable de cualesquiera daños y perjuicios puedan producirse, ni de los defectos técnicos, incluidos virus u otros elementos lesivos, cualquiera que sea la naturaleza, derivados del uso de la información y de las materias contenidas en la web. 4. Uso de cookies. Con el objeto de prestar un mejor servicio, puede que PREDIF llegue a almacenar en el ordenador del Usuario pequeños ficheros de información denominados cookies, los cuales pueden ser utilizados para el correcto funcionamiento de algunos de los servicios que se ofrecen, así como para realizar estadísticas de uso, diagnosticar problemas en la web, y para la administración de algunos de los servicios ofrecidos. En caso de utilizar cookies será establecido en una política independiente que figurará en el mismo lugar que el resto de información legal de http://www.predif.org. Para limitar o restringir la admisión de cookies en su equipo, el Usuario puede configurar su navegador a estos efectos. 5. Responsabilidades. El Usuario responderá de los daños y perjuicios de toda naturaleza que PREDIF o cualquier tercero pueda sufrir como consecuencia del incumplimiento de cualquiera de las obligaciones a las que queda sometido por las presentes Condiciones Generales. PREDIF no asume ninguna responsabilidad ni realiza ningún control sobre los posibles hipervínculos que contenga la web a contenidos externos a la misma; no obstante, retirará aquellos enlaces que incluyan contenidos ilícitos tan pronto como pueda conocerlo. 6. Propiedad Intelectual e Industrial. El Usuario reconoce que todos los contenidos de la web y, en concreto, de toda la información y materiales, la estructura, selección, ordenación y prestación de sus contenidos, programas y desarrollo de aplicaciones utilizados en relación con ellos, están protegidos por derechos de propiedad intelectual e industrial propiedad del titular de la web o, en su caso, de terceros. PREDIF es titular de los elementos que integran el diseño gráfico de su web, los menús, botones de navegación, el código, los textos, imágenes, texturas, gráficos y cualquier otro contenido de la página web o, en otros casos, dispone de la correspondiente autorización para la utilización de dichos elementos. Todas las marcas, nombres comerciales o signos distintivos mostrados en esta página son propiedad de PREDIF y/o de terceras empresas. Se prohíbe usarlos o descargarlos permanentemente, copiarlos o distribuirlos por cualquier medio sin el preceptivo consentimiento de su titular. En el caso de que cualquier Usuario o un tercero consideren que cualquiera de los contenidos ha sido introducido en la web con violación de sus derechos de Propiedad Intelectual o Industrial deberá enviar una notificación a PREDIF identificándose a sí mismo y al titular de los derechos de propiedad intelectual o industrial supuestamente infringidos, aportando título o acreditación de la representación de los mencionados derechos. 7. Protección de datos. En cumplimiento de lo dispuesto en el artículo 5 de la Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal (en adelante, "LOPD"), PREDIF, le informa de que los datos de carácter personal que nos ha proporcionado mediante la cumplimentación de cualquier formulario electrónico que aparece en nuestro Web Site, así como aquellos datos a los que PREDIF acceda como consecuencia de su navegación, de la consulta, solicitud o contratación de cualquier servicio o producto, o de cualquier transacción u operación realizada a través del Web , serán recogidos en un fichero cuyo responsable es PREDIF con domicilio a estos efectos en Avenida Doctor Garcia Tapia, 129 Local 5 28030 Madrid donde podrá ejercer su derecho de acceso, rectificación, cancelación y oposición al tratamiento de sus datos personales, en los términos y condiciones previstos en la propia LOPD. La no cumplimentación de los campos obligatorios que aparecen en cualquier formulario de registro electrónico podrá tener como consecuencia que PREDIF no pueda atender a su solicitud. Las finalidades de la recogida de sus datos personales son las que particularmente se indiquen en cada una de las páginas donde aparezca el formulario de registro electrónico. Legislación aplicable y jurisdicción. Las presentes Condiciones Generales se regirán por lo dispuesto en la legislación española. The purpose of this text is to lay down and regulate the terms of use of the website http://www.allmadrid4all.com (hereinafter “the Site"), deemed to include all the pages and their content, owned by PREDIF, which can be accessed via the domain http://www.allmadrid4all.org and its subdomains. 2. Users acknowledge that when they access and use the Site and its content, they do so freely and fully aware of their actions, assuming sole responsibility for them and therefore undertake:
PREDIF does not guarantee the availability or continued operation of the Site and shall not be held liable for any loss or damage that may arise, or for any technical problems that may occur, including viruses or problems caused by other harmful components of any kind, as a result of use of the information and material on the Site. 4. Use of Cookies. In order to provide a better service, PREDIF may store small information files on users’ computers known as cookies, which can be used to ensure that some of the services they offer function correctly, as well as to collect usage statistics, identify problems on the Site, and manage some of the services offered. Liability Users shall be liable for all and any types of loss or damage suffered by PREDIF or any third party as a result of failing to comply with any of their obligations under these Terms of Use. PREDIF shall not be liable in any way for and will not carry out any checks on hyperlinks to content on other websites that the Site may contain. Nonetheless, it shall remove any links that include unlawful content as soon as possible after becoming aware of their presence. 6. Intellectual and Industrial Property Users hereby acknowledge that all the Site content, and in particular all the information and materials, the structure, selection, arrangement and provision of its content and programmes, and the development of applications used in relation to them, are protected by intellectual and industrial property rights that belong to the owner of the Site, or as the case may be, third parties. Under no circumstances shall access to or use of the abovementioned content by users imply any kind of waiver, transfer or assignment of all or any part of the said rights, or grant any right to use, change, exploit, reproduce, distribute or communicate to the public such content without express prior authorisation specifically given for that purpose by PREDIF or any third party who owns the rights in question. PREDIF is the owner of the Site’s graphic design components, the menus, navigation buttons, code, texts, images, textures, graphics and all other content of the Site, or as the case may be, has the relevant authorisation to use such components. All the trademarks, brand names and logos shown on the Site are owned by PREDIF and/or other organisations. Using, downloading, copying or distributing them by whatever means is prohibited at all times without the required consent from the owner. Any user or third party who considers that any of the content has been placed on the Site in breach of their intellectual or industrial property rights should notify PREDIF in writing, identifying themselves and the owner of the intellectual or industrial property rights that have allegedly been infringed, providing certification or evidence of ownership or of the authorisation to act on behalf of the owner of the rights in question. 7. Data Protection. In accordance with the provisions of article 5 of Organic Law 15/1999, dated the 13th December, on the Protection of Personal Data (hereinafter "LPPD"), PREDIF hereby declares that any personal data provided by users when filling out any of the forms on the Site, along with any data to which PREDIF has access as a result of a) users browsing, looking up information, requesting or engaging any service or product on the Site, or b) any transaction or operation carried out via the Site, shall be stored in a file for which PREDIF shall be responsible, whose address for this purpose is Avenida Doctor Garcia Tapia, 129 Local 5 28030 Madrid, where users can exercise their right to access, rectify, remove and object to the handling of their personal data in accordance with the terms and conditions laid down in the LPPD. If users fail to fill out required fields on any of the online registration forms, this could result in PREDIF being unable to deal with their requests. The purposes for which personal data on users are collected are those that are specifically indicated on each of the pages where the registration forms appear. Generally, personal data that users provide us with shall be used for dealing with their requests for information as well as to inform them about new activities, products and services. Consent to provide personal data can be revoked at any time, although it shall not take effect retroactively. Applicable Law and Jurisdiction These Terms of Use shall be governed by the provisions of Spanish law.
